Paraquat Lawsuit: Herbicide Linked to Parkinsons Disease

Most cases of the disease occur randomly and do not seem to run in family bloodlines. But researchers believe that Parkinsons disease results from a combination of both genetic mutations and environmental factors. Occupational pesticide exposure, farming work, well water consumption, and residential pesticide use have all been linked to elevated rates of Parkinsons disease .

Studies have found an association between two common agrochemicals and Parkinsons disease. One study concluded that low-level exposure to pesticides and specific agrochemicals may disrupt cells in a way that mimics the effects of mutations known to cause Parkinsons disease.

Even low-level exposure for those with a genetic predisposition for Parkinsons disease drastically increases the risk of developing the disease. Epidemiological research demonstrates an increased risk among farmers and others exposed to agricultural chemicals. People exposed to these some herbicides are at about a 250-percent higher risk of developing Parkinsons disease than the general population, according to the study.

Other Health Risks Associated With Use Of Paraquat

The link between paraquat and Parkinsons Disease is not the only thing that agricultural workers should be concerned about. Use of the herbicide can also result in poisoning via ingestion, inhalation, and skin exposure.

Licensed applicators are at risk of poisoning, which causes toxicity throughout the body, primarily in the lungs, liver, and kidneys. Long-term health problems associated with paraquat dichloride poisoning include lung scarring, kidney failure, heart failure, and scarring of the esophagus.

Who Was Exposed To Paraquat

Unlike other dangerous chemicals, such as glyphosate, paraquat is not licensed for residential use, and only licensed applicators can use it. This means that you likely havent inadvertently used paraquat around your home, and those exposed tend to be farm workers and anyone licensed to use the chemical.

Nonetheless, paraquat is one of the most commonly used herbicides according to the CDC and the EPA. This means that while the average home gardener is not likely to be exposed to paraquat, farm workers and licensed applicators do have a high likelihood of exposure.

Its also possible to have been exposed to paraquat if your spouse works on a farm or if your home is near a farm or orchard.

The biggest risk of exposure and paraquat poisoning is through swallowing the liquid. Its also possible to become poisoned through skin exposure. This might happen over a long period of minimal exposure or from a singular high exposure. Exposure through the skin is more dangerous when you have a cut, rash, or sore.

Its possible to be exposed through inhaling the chemical as well, which could happen while it is being applied. The chemical has been found in marijuana in the past as well.

Even as studies and anecdotal cases point to the dangers of paraquat, the chemical is still widely used in the United States with people largely being unaware of the dangers.

Justinian & Associates Has Always Helped People Who Were Injured By Dangerous Products

Paraquat Lawsuit Attorneys

Personal injury lawsuits involving dangerous products like drug prescriptions, or chemicals like Agent Orange or Paraquat are typically more complicated than the average fender-bender.

Paraquat Injury Lawsuits Can Be Very Complex to Prove

Winning a mass tort lawsuit for injuries caused by a dangerous chemical like paraquat usually involves proving that the manufacturers did not properly warn people taking it of the potential risks.

That can include investigating medical studies, corporate publications and using testimony from experts on how the medication caused an injury.

A lawsuit for Paraquat may involve getting historical data to prove how an injured victim was exposed.

Showing how a product caused an injury can require legal and scientific expertise which many Austin personal injury attorneys simply do not have.

Your lawsuit for Parkinsons injuries brought on by Paraquat exposure may be combined with other lawsuits against Paraquat manufacturers or distributors.

Cases involving dangerous products are often combined into a larger lawsuit like a class-action lawsuit or a mass tort lawsuit.

These cases often involve tens of thousands of injured consumers, and courts may look at all the cases at once. These types of lawsuits are known as mass torts.

Justinian & Associates has focused on mass torts involving dangerous products since we were founded. We have successfully represented many victims harmed by large chemical and pharmaceutical manufacturers.

What Damages Can I Recover From A Paraquat Claim

Money damages are typically awarded in civil court cases where someone suffers a loss due to another partys negligence or unlawful conduct. In essence, you can get three types of different damages if your Paraquat lawsuit is successful. These include compensatory damages, general damages, and punitive damages.

The general and compensatory damages awarded to a plaintiff compensate you for medical expenses, loss of employment, pain, suffering, loss of consortium, mental anguish, or other losses.

The punitive damages can only be awarded to you if an authoritative party deems a defendants conduct as malicious or wanton. In a nutshell, punitive damages are intended to punish the defendants conduct. If appropriate, our attorneys will help you prove your losses in a court of law.

The Paraquat cases are too early on to determine the amount of compensation that you might be awarded. The amount of compensation will be determined by many factors, including whether you need the assistance of another person to perform everyday tasks and what medical expenses you will likely incur in the future.

Notably, the families of those who have died may be eligible to recover money for funeral expenses and the pain that comes with losing a loved one, among other damages.

Is Paraquat Banned In The United States

While many countries in the world have banned paraquat, in the United States, the weed killer is still in use on many farmlands sprayed with the deadly weed and grass killer.

There are no federal or state laws that ban consumers from buying or using paraquat. However, no one can sell the chemical to anyone under 18. In addition, the US Department of Transportation restricts the herbicide to transport on public roadways because of its toxicity.

In the United States, multiple states have issued a ban on paraquat for any agricultural purpose. Using paraquat as an active ingredient against plants and vegetation is illegal.

Two of the states that have banned paraquat:

Although paraquat has been banned in some states, it is still legal in other states. In the states where paraquat is still legal to use and purchase, federal agencies have restricted its transportation on public roadways due to toxicity concerns.

The paraquat lawyers at Rosenfeld Injury Lawyers represent victims harmed by the toxic chemical, including those diagnosed with Parkinsons disease.

Update From Our Cso: Pesticides Paraquat And Parkinsons

We are 100+ years since the publication of James Parkinsons essay the Shaking Palsy describing his eponymous disease. Yet, aside from a small number of individuals who have clear genetic causes to their disease, we still do not know the reason why the majority of people develop Parkinsons disease .

Based upon current research, scientists believe that Parkinsons is most likely caused by a combination of genetic and environmental factors. The interactions between genes and the environment can be quite complex. Some environmental exposures may lower the risk of PD, while others may increase it. Learn more in our article, Pesticides and Parkinsons: Time to Strengthen Epidemiology.

Specifically, as researchers, we need to better understand the predisposition to develop Parkinsons based on a persons genetics and environmental factors. One thing science has shown is that the exposure of certain chemicals in pesticides can lead to people having an increased risk developing Parkinsons. However, it is important to note, that even when a pesticide is linked to Parkinsons, not every person exposed to certain chemicals in pesticides will go on to develop this life-changing disease.

Health Studies Show The Connection Between Paraquat And Parkinsons:

Paraquat Linked To Parkinson’s Disease
  • More than twenty years ago, reports of a link between herbicides and the development of Parkinsons led researchers to discover that Paraquat can cause Parkinsons type brain lesions in mice.5

Farming, rural living, well water drinking, and exposure to agricultural chemicals are all conditions that have been associated with an increased risk for Parkinsons Disease, and paraquat is the pesticide that has most often been implicated as a potential neurotoxicant in Parkinsons.6

  • Ten years ago, the U.S. National Institute of Health conducted a large-scale study of Parkinsons in southern and midwestern farming families, and the herbicides and pesticides that they had used.

In 2010, the National Institute of Health study found a link between herbicides containing paraquat and the development of Parkinsons Disease.7

Paraquat is a potent toxin that kills plants by limiting . Scientists are still studying all the ways that Paraquat can affect living organisms.

Paraquat exposure can cause cellular senescence , a phenomenon which is associated with Parkinsons Disease. This may help explain the growing body of research finding a connection between paraquat and Parkinsons.8

The Ghosts Of Pesticides Past

Over the past half century, we have begun to identify the worst risks and address them. The insecticide DDT was once considered a miracle compound. In the 1930s, the Swiss chemist Paul Hermann Müller was looking for a chemical that could kill insects that were destroying crops and spreading diseasewithout harming the plants. Müller, a nature lover, tested hundreds of chemicals before coating the inside of a glass box with DDT, a colorless, tasteless, and almost odorless nerve toxin. He placed houseflies into the container, and they bit the dust. Müller had found his answer.

In the 1940s DDT was considered harmless to humans and regularly sprayed on neighborhoods here children play in the sprays at the beach in New York. Even though DDT was banned half a century ago, it persists in the environmentand in our food supply. It becomes more concentrated as it makes its way up the chain to human consumption. The pesticide is then stored in fatty tissues, including the brain. DDT has been linked to Parkinsons disease. Because of the widespread use of the pesticide, DDT and its breakdown products are detectable in nearly everyone in the United States. It has also been found in the breast milk of women living in Spain, Nicaragua, Taiwan, and the Spanish Canary Islands as recently as 2014.

Reactivity And Mode Of Action

Paraquat is an oxidant that interferes with electron transfer, a process that is common to all life. Addition of one electron gives the radical cation:

2+ + e
}} 0

As an herbicide, paraquat acts by inhibiting photosynthesis. In light-exposed plants, it accepts electrons from and transfers them to molecular oxygen. In this manner, destructive reactive oxygen species are produced. In forming these reactive oxygen species, the oxidized form of paraquat is regenerated, and is again available to shunt electrons from photosystem I to restart the cycle. This induces necrosis, and unlike with some mechanisms of necrosis, does not produce double-stranded breaks.

Paraquat is often used in science to catalyze the formation of ROS, more specifically, the superoxide free radical. Paraquat will undergo redox cycling in vivo, being reduced by an electron donor such as NADPH, before being oxidized by an electron receptor such as dioxygen to produce superoxide, a major ROS.

Glyphosate Boosts Parkinsons Risk

Paraquat Linked to Parkinson’s Disease

In a 2018 study, researchers from Brazils University of Campinas tested 10 commercial brands of infant formulas. They found glyphosate residues at levels ranging from .02 to .17 milligrams per kg. in the formulas. The researchers linked the glyphosate and its metabolite, aminomethylphosphonic acid to Parkinsons:

Recently, glyphosate and its metabolite aminomethylphosphonic acid have been identified as possible contributors to the emergence of various diseases such as autism, Parkinsons and Alzheimers diseases, as well as cancer.

Glyphosate has been linked to Parkinsons in other studies. A 2013 study found that because glyphosate inhibits the P450 enzymes, and it builds up in tissues, it damages cells and produces brain toxicity.

A 2006 study followed 55,931 people who worked in agriculture. They found those who handled pesticides and herbicides the most had about double the risk of Parkinsons disease.

Controversial Herbicide Paraquat Linked To Parkinsons Disease

March 5, 2021 in Product Liability

Over the last decade, studies conducted on the controversial, yet commonly used herbicide Paraquat, demonstrate its links to an increased risk of Parkinsons disease. Although manufacturers have been aware of the link between Paraquat and serious health risks, the herbicide continues to be sold without adequate warnings.

What is Paraquat and Why is it Controversial?

First introduced in 1962, the herbicide was developed to maintain grass and weed control. The cheap and fast-acting herbicide quickly became a standard item for farmers across the country.

While Paraquat is an effective weed killer, it is also lethal in small doses and is known as an instrument used to commit suicide. Due to Paraquats numerous health risks, at least 32 countries have entirely banned using the herbicide. However, use of Paraquat in the United States has actually increased, with a U.S. Geological Survey indicating a doubling from 2013 to 2017, when an estimated use of Paraquat reached 10 million pounds annually. Paraquat is one of only two pesticides still used in the United States that is either banned or phased out in the European Union, China and Brazil.

The Risks of Paraquat Exposure

However, these measures remain inadequate, as they fail to warn about the risk of Parkinsons disease and fail to prevent exposure or prevent exposure to the harmful chemicals through:
